These terms are a contract between you and Bourbon Project ("Bourbon Project", "we", "us"). They cover the Bourbon Project mobile app, the website at bourbonproject.com and everything we provide through them (together, the "Service"). Please read them. By installing, opening or using the Service you accept them. If you do not accept them, do not use the Service.
1. This agreement
Our Privacy Policy and our Community Guidelines form part of these terms. Where a store you bought a membership through imposes its own rules, those rules also apply to that purchase.
2. Who may use the app
The Service is about distilled spirits and is intended only for people who are of legal drinking age where they live. In the United States that means you must be at least 21 years old. By using the Service you confirm that you meet that requirement.
The Service is not directed at children, and we do not knowingly allow anyone under legal drinking age to create an account. If you believe an underage person holds an account, write to support@bourbonproject.com and we will close it.
Bourbon Project does not sell, ship, broker or arrange the sale of alcohol. The Service is a reference, record keeping and community tool. Nothing in it is an offer to sell anything you can drink.
3. Accounts and guest access
You can browse the catalog, distilleries, cocktails and news as a guest without an account. A profile is required to keep a collection, post in discussions or receive alerts.
When you create a profile you agree to:
- give accurate information and keep it current;
- keep your password to yourself and not share your account;
- accept responsibility for everything done through your account, unless you have told us it was compromised.
You may delete your account at any time from Settings. Deletion removes your profile, your collection and your posts as described in the Privacy Policy.
4. Your content
"Your Content" means anything you put into the Service: collection entries, notes, photographs, discussion posts and replies, profile details, reported prices and messages to support.
You keep ownership of Your Content. You give us a worldwide, non exclusive, royalty free licence to host, store, reproduce, adapt for display and distribute Your Content, but only so that we can operate, secure and improve the Service. For content you post publicly, such as a discussion thread, that licence includes showing it to other members. The licence ends when you delete the content or your account, except for copies we are required to keep by law and for backups that expire on their normal schedule.
You confirm that you own Your Content or have the right to post it, and that posting it does not break the law or anyone else's rights. Do not upload photographs you did not take or do not have permission to use.
Prices you report are contributed to a shared record. Once a reported price is part of that record, it may be used in aggregate valuations and price history shown to other members, without your name attached.
5. Conduct and community rules
You agree not to:
- post anything unlawful, harassing, hateful, threatening or deliberately misleading;
- offer to buy, sell, trade or ship alcohol through the Service;
- impersonate anyone, or misrepresent your connection to a distillery or brand;
- post spam, advertising or affiliate links without our written permission;
- submit prices you know to be false, or manipulate valuations;
- scrape, mine or bulk copy the catalog, price data or member content, or use automated means to access the Service;
- probe, disrupt or overload our systems, or try to reach data you are not entitled to;
- reverse engineer the app except to the extent the law says you may.
The Community Guidelines explain in plain terms what good behaviour looks like in the forum.
6. Reporting, blocking and moderation
Every post and every member can be reported from inside the app, and you can block any member. Blocking hides that member's posts and replies from you immediately.
We review reports and act on them, usually within 24 hours. We may remove content, limit an account or close it where content breaks these terms or the Community Guidelines. We can also remove content that creates a legal risk for us. We are not obliged to monitor everything posted, and we do not endorse any member's opinion or tasting note.
If you believe content on the Service infringes your copyright, write to support@bourbonproject.com with enough detail to identify the work and the post, and we will investigate.
7. Memberships and billing
The Service has a free tier and paid tiers. Paid tiers are sold as auto renewing subscriptions through the Apple App Store or Google Play, and in some cases as a one time purchase.
- Billing. Your store charges you, not us. Payment is taken at confirmation of purchase and again at each renewal, at the price shown at the time.
- Renewal. A subscription renews automatically unless you cancel at least 24 hours before the current period ends.
- Cancelling. Manage or cancel in your Apple ID or Google Play account settings. Uninstalling the app does not cancel a subscription. Cancelling stops the next charge and leaves your access running to the end of the paid period.
- Refunds. Refunds are handled by the store under its own policy. We cannot issue a refund for a store purchase, but we will help you with a request.
- Price changes. If we change a subscription price, we will tell you before it takes effect, and your store will ask you to confirm where its rules require that.
- Launch period. Pro features may be unlocked for all accounts during a stated launch period. That is a promotion, not a subscription. Nothing is charged, and when the period ends, accounts that have not purchased return to the free tier, except for founding accounts that were granted a permanent Pro entitlement.
- Downgrades. If you return to a lower tier, your data is not deleted. Features and limits that belong to the higher tier simply stop applying, and content above a free tier limit becomes read only rather than being removed.
8. Prices, valuations and appraisals
Price information comes from reported observations, including retail prices and prices entered by members. It is not a quotation, an offer, or a verified market rate. Secondary market prices for whiskey move quickly, vary by region, and are often unlawful to transact on.
Valuations, charts, cost basis figures and appraisal documents are estimates provided for your own record keeping. They are not financial, investment, tax or insurance advice, and they are not a certified appraisal. No insurer, buyer or authority is obliged to accept them. Get a professional appraisal where the value matters.
We do not warrant that any price, valuation or catalog detail is accurate, current or complete, and we are not liable for decisions you make on the strength of them. If you think a figure is wrong, report it in the app so we can look at it.
9. Bottle scanning
Scanning uses your device camera, with your permission, to read a barcode or a label so the app can identify a bottle. Label images may be sent to a text recognition service to be read. Identification is a best effort and can be wrong, so check the match before you save it. Scans are metered per month by tier.
10. Third party content and services
The Service shows content we do not control, including news headlines and summaries from publishers, cocktail recipes from a third party recipe database, and images and details supplied by distilleries and retailers. That content belongs to its owners, is linked back to its source where possible, and we do not guarantee it. Following a link takes you to a site governed by someone else's terms.
11. Our intellectual property
The app, the website, the Bourbon Project name and mark, the curated catalog and its arrangement, and the software behind all of it belong to us or our licensors. We give you a personal, non transferable, revocable licence to use the app on devices you control, for your own non commercial use. Brand names, labels and trademarks of distilleries belong to their owners and appear here for identification only. Bourbon Project is not affiliated with, endorsed by or sponsored by any distillery or brand shown in the catalog.
12. Suspension and termination
You can stop using the Service and delete your account at any time. We may suspend or close an account that breaks these terms, that creates risk for other members, or where we are required to by law. Where it is reasonable to do so, we will tell you why and give you a chance to respond. Sections that by their nature should survive termination, including content licences already granted, disclaimers, liability limits and governing law, survive it.
We may also change or discontinue features. If we discontinue the Service entirely, we will give reasonable notice so you can export your collection.
13. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy and non infringement. We do not warrant that the Service will be uninterrupted, timely, secure or error free, or that catalog, price or news data will be accurate or complete.
Nothing in the Service is medical advice. Drink responsibly and lawfully.
14. Limitation of liability
To the fullest extent permitted by law, Bourbon Project and its officers, employees and suppliers are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost data, lost goodwill, or the cost of substitute services, arising out of or connected with your use of the Service.
Our total liability for all claims relating to the Service in any twelve month period is limited to the greater of the amount you paid us for the Service in that period, or fifty United States dollars.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. Where that is the case, the exclusions and limits above apply only to the extent permitted, and nothing here limits liability for fraud, death or personal injury caused by negligence.
15. Indemnity
You agree to indemnify and hold Bourbon Project harmless from claims, damages, losses and reasonable legal costs arising from Your Content, your use of the Service, or your breach of these terms or of the law.
16. Changes to these terms
We may update these terms. When we make a material change we will update the date at the top of this page and give notice in the app before the change takes effect. Continuing to use the Service after that means you accept the updated terms. If you do not accept them, stop using the Service and delete your account.
17. Governing law and disputes
These terms are governed by the laws of the Commonwealth of Kentucky, United States, without regard to its conflict of law rules. You and we agree that the state and federal courts located in Kentucky have exclusive jurisdiction over any dispute that is not resolved informally, except that either party may seek injunctive relief in any competent court to protect its intellectual property.
Before filing anything, please write to support@bourbonproject.com. Most disputes can be settled in an email.
If you live somewhere that gives you mandatory local consumer rights, those rights are not affected by this section.
18. App Store and Google Play
If you obtained the app from the Apple App Store, the following applies. This agreement is between you and Bourbon Project only, not with Apple, and Apple is not responsible for the app or its content. Apple has no obligation to provide support for the app. If the app fails to conform to any applicable warranty you may notify Apple, and Apple may refund the purchase price; to the maximum extent permitted by law Apple has no other warranty obligation with respect to the app. Apple is not responsible for addressing claims relating to the app, including product liability, regulatory compliance or intellectual property claims. You confirm you are not located in a country subject to a United States embargo or designated as terrorist supporting, and that you are not on a prohibited party list. Apple and its subsidiaries are third party beneficiaries of this agreement and may enforce it against you.
If you obtained the app from Google Play, your use is also subject to the Google Play Terms of Service, and Google is not a party to this agreement.
